Dear Sir or Madam,
Ref: Delivery complaint due to breach of contract
On 20th December 2017 you agreed to sell me items from your home range.
The delivery was promised for the 27th of December originally and I waited all day because it was scheduled from 1:30 -5:30. After 5:30 I gave your customer service ring and I was told that the delivery would be late. I cancelled my shift as I was expecting guests for New Year and would have liked them to use the new Ikea crockery etc. The delivery never turned up and I then rang your customer service centre.
I was told around 10pm that the delivery would now come on the 4th of January. I took another day off and I have been waiting around now from 1:30pm and still there has been no delivery. Overtime I call your help-line, I get put on on hold (I have recorded this on my iPhone.
It was agreed you would deliver to me on 4th January. You failed to deliver. This was the second time I was let down and you could not deliver when I wanted you to. However, I incurred loss due to your breach of contract.
I was compelled to take unpaid leave on the 27th of December and on 4th January for which represented a net loss to me of £200. I am writing to claim this amount from you. I look forward to a full and prompt response to this letter within 14 days. Failing this, I will bring proceedings against you in the county court for damages, and interest on them at the rate of 8% per annum and costs.
It was agreed delivery would be 7 working days but so far delivery has not taken place. The delay has been undue and cannot reasonably be expected to continue indefinitely.
Therefore, I am hereby making time of the essence and giving notice that unless the goods are delivered to me no later than 21 days. I will treat you as having repudiated the contract and call on you to refund all sums I have paid you, together with damages for breach of contract. This will include my expenses in having to buy the same goods elsewhere, and any amount in excess of the price I paid to you.
I look forward to your response within the next 14 days.
