My company delivers specimens for many medical facilities throughout the state of Texas. Today David McDavid Ford in Pasadena, Texas towed my one of my drivers cars away. That, in and of itself is not a big deal, they were well within their right, because this driver owed them money. However, when we notified them that there were specimens in the vehicle, they refused to let us retrieve them. They told us we could have them if we paid the $865.00 that the driver owed them. We told them we had no fiduciary responsibility to assume the debt of the driver. However, it is a huge OSHA/Hipaa violation for this dealership to have our clients specimens in their possession. We went to the dealership to retrieve the specimens and they still refused to let us have them. Here is where I am at. Your dealership is not trained to properly dispose of patient specimens. That is a OSHA violation. They should not have the specimens in their possession, that is a Hipaa violation. I have been asked by the customer to retrieve their specimens. I am going back to the dealership in the morning to attempt that. The man we spoke to is named Bob. His ph# is 713-943-4896. If when I go in the morning to retrieve them, I am refused again, I will begin legal proceedings, as well as reporting your company to OSHA for the extremely serious violation. I would hope we could work this out reasonably. The patients whos lives are at risk should not suffer because your team at David McDavid havent the first clue about patient rights and as well as the law surrounding specimen integrity.
