Hello and please read my message:
My name is Kristina Kastanek and unfortunately I was involved in an auto accident on July 5, 2015. That day I picked up my lunch at Dominoâs Pizza at 111 Plaza Drive, Palm Coast, Fl 32137 and was headed home to 207 S. Flagler Avenue, Flagler Beach, Fl 32136. It is a straight drive east on Hwy 100 (E. Moody Blvd) then I make a right once Iâm over the Flagler Beach bridge. So I was traveling east on Hwy100 just past the Colbert lane intersection (double lane road with a light) traveling at no more than 50mph (posted speed limit) in the right hand lane when I am approaching a U-turn area in the median. At this point a white Dodge 4 door vehicle recklessly cut into the left lane while making the U turn which was extremely close to cutting me off. Should the Dodge stayed in the left lane it would have been too close for comfort but there would never had been an accident. Unfortunately, while the Dodge made the U turn in the left lane headed (east now) the driver decided as it straightened out to cut right in front of me to enter the right hand lane directly in my path while traveling at about a quarter of my speed. This left me no other option but to collide into the rear bumper of the white Dodge. It appeared he wanted to turn right into a gas station that was to the right of where all this took place. So now I have now been harmed by an irresponsible driver that stated he didnât see me; because should he have; I honestly believe he wouldâve never made that U turn until I had passed. There were no other vehicles around me and it was clear he didnât see me!
My vehicle, which was a 2001 Ford Mustang, has been totaled because both air bags deployed. Since I was upside down on the loan for the Mustang for about $3000.00, I now owe that money to the dealer. I have had to pay out of pocket on a rental vehicle for 3 weeks just so I could get to work and back. My insurance rate has gone up from $125.00 to $250.00/month. All the rest of the month of July I had my life completely uprooted because of the carelessness of the driver of the Dodge because I was the one found at fault. I pleaded with the insurance company to reinvestigate the details of the case but it seemed the entire time they just couldnât be bothered. This was most likely a small claim to them but to me it was everything I had worked so hard to accomplish just to have my own car.
This is now months later and the reason I am writing this is because I have been contacted by Progressive agent Joel stating that if I did no sign an affidavit, Chris Thomas (the driver of the white Dodge) is going to be suing me past the 10,000.00 coverage on my insurance with Progressive. NOW on top of all this he claims he was hurt and is going to get more money from insurance because his insurance company has more fighting power. ReallY???
I find this very unfortunate because should Progressive have done a sufficient investigation, I would not be the one being sued. I truly feel that the âmanyâ agents my case has been tossed between, maybe if one of those many agents had done a true investigation this case would have had a different outcome.
I have come to terms with losing my Mustang. I have come to terms with losing money from missing days and time at work and paying out on a rental vehicle. I have come to terms with paying an extra $125.00 a month in insurance. But I cannot come to terms with being sued for this accident.
You have received this letter because I am at my wits end and am sending it out to whomever I think would have an interest in whatâs true and whatâs right. I have nowhere else to go. I have no one that will fight for me. I have nothing but my insurance company telling me I am at fault for an accident I didnât cause.
