Dear Sir,
On Monday, June 27, 2016, one of your agents by the name of Rebecca Garcia contacted La Victoria Senior Citizen Center and stated that she had an appointment with mother. My mother, Esther Tapia, attends the center regularly. I must clarify that my mother is no longer enrolled in the Molina Healthcare system and did not request an appointment nor did express interest in enrolling in your program. My mother is 88 years old. She is hearing and visually impaired. Because my mother suffers from mild dementia, she is no longer able to make medical decisions or enter into legal contracts and, for that reason, has given medical power of attorney to Martha who is one of Esther's children. Your aforementioned agent requested that the senior citizen center send my mother home an hour earlier than usual in order to meet with my mother at her home located at 556 Venado Drive in El Paso, Texas. My mother's home is equipped with surveillance cameras. Ms. Garcia is captured rummaging through my mother's possessions as well as inspecting every room in the house. The surveillance cameras show Ms. Garcia filling out an application and proceeded to provide a pen for my mother to sign an application or contract that my mother is incapable of reading due to her disability. We can only conclude that the application was to enroll in the Molina healthcare system. We consider this matter to be of a very serious nature and are prepared to seek legal counsel. We will also be contacting a Justice of the Peace in order to seek an injunction against your firm in addition to contacting the media in order to bring attention to the predatory practices that your representatives are engaged in.
