Sir
Thank you very much for offering possession of my apartment booked six years ago. But I am disturbed looking to the final statement mailed to me yesterday. Major area of concerns are:
A. Increase in Super Area from 133.32 Sq Mt to 143.07 Sq Meter without any corresponding increase in Carpet Area
• I had booked this apartment on 15th April 2009 with 133.32 Sq Meter Super Area with all approved layouts in place. BBA was signed accordingly.
• After six year you had increased the carpet area from 133.32 Sq Meter to 137.93 Sq Meter in 2015 without any valid reason and without any changes in carpet area. This was done after the entire superstructure was created.
• The sizes of rooms and Balconies have been reduced from the area mentioned in the BBA.
• I had raised major objection on seeing the apartment on 27th June 2016 with a reminder on 29th August 2016 which you have not bothered to reply.
• In the final statement, you have further increased super are to 143.07 Sq Meter . It is highly unjustified to increase the super area without any corresponding increase in carpet area.

B. Price Charged for Additional Car Parking
Vide your mail dated 24th August, you had agreed to give additional car parking at the same rate at which initial booking was made. But you have charged Rs 1,50,000 extra from me for additional car parking.
My initial allotment was @ 3 lacs and additional parking has been charged @ 4.5 Lac.

As indicated to you earlier vide my mail dated 27th June and 29th August, I would like to surrender additional car parking.
Please adjust payment already made in for additional car parking towards amount due.

C. Delay of 4.5 Years in offering possession
You have not compensated for exorbitant delay in offering the possession. Despite making 100% payment of our flat, We are paying interest EMI and forced to live in rental accommodations.
Please give us 9% PA interest as is ordered by various courts for the period possession is delayed.
